Lok Sabha Committee on Subordinate Legislation (COSL) takes up Real Estate (Regulation and Development) Act (RERA) rules by various states with the officials of HUPA on last Wednesday, April 26.
During this one hours conversation, COSL reviews the of proceedings and progress of RERA execution scheduled on May 1, and also put across their concern to the Ministry of Housing and Urban Poverty Alleviation (HUPA) over intensity of these regulations. During this meeting, COSL raised many other questions that are expected to be replied by the ministry over the coming few days.
COSL had drafted a letter to the ministry over 10 days ago with a 32-point query, including questions regarding to the status of RERA implementation, establishment of regulatory authority and appellate tribunal by state governments and suspension of rules by various state governments.
Protecting buyers’ rights was the center of discussion. Also the strict and appropriate application of RERA was also discussed. Side by side few more new topics were there as a part of this debate. The feedbacks also will be scrutinized by an individual committee and COSL will give the concluding nod after that.
A pan-India homebuyers’ authority Fight for RERA had aimed the mediation of COSL of both the Houses of parliament to make sure that the final regulation are attributed and implemented by the states within the deadline.
After the act was notified on May 1, 2016, all states were mandated to notify the closing rules within six months. Thereafter, as of now Maharashtra, Uttar Pradesh, Madhya Pradesh, Rajasthan, Gujarat and Odisha have finalized their rules.
Supporting the RERA implementation, The MD of Somani Realtors PVT. LTD, Mr. Mahesh Somani said, “COSL intervention was necessary starting from the time of the act was notified. State governments are found curbing this central law to draw favors in builders’ court. This is a major reason, for RERA couldn’t be successfully implemented.”
Meanwhile, COSL had issued letters to the PM, Union Minister of Housing, Union Minister of Urban Development and Poverty Alleviation and also to the chief ministers of UP, Haryana and Gujarat to emphasize such dilution of rules. HUPA has already finalized notified RERA rules of 5 UTs by Oct 31. Successful implementation of RERA will offer justice to distress homebuyers.
